Our firm has been retained by the Buyer to conduct the real estate closing on the above referenced property.
You have the right to engage your own legal counsel to represent you and/or prepare the documents required in connection with this transaction. Seller documents must be prepared by a licensed attorney. If you choose our firm to assist, we will prepare the Deed, Lien Waiver, 1099, FIRPTA and any other seller documents required for a fee of $500.00. However, there may be additional fees such as wire, or overnight charges incurred to transfer funds for a loan payoff.
The State of North Carolina requires that the seller pay on the sale of real property, an excise tax of $2 on each $1,000 of consideration for the property conveyed. The tax is paid by the seller to the Register of Deeds and will be reflected on your closing statement.
In North Carolina, if you are married, regardless of whether your spouse appears on the deed, he or she is required to execute the deed of conveyance, together with certain other required documents.
Finally, the most important thing for most sellers is how to obtain their proceeds and when they will be disbursed. When closings occur no later than mid-morning, the proceeds typically are available the same day. However, with closings occurring in the afternoon, proceeds may not be available until the following day. Our office cannot guarantee when your funds will be available; however, we do guarantee that there will be no recordation of the seller documents until buyer funds are deposited in our trust account.
